As of July 2012, there are approximately 1,800 Fosamax cases pending against Merck in both state and federal courts in New Jersey. Those cases are divided into two multidistrict litigation (MDL) proceedings: one at the state level; the other at the federal level. Judge Carol E. Higbee is presiding over the state cases, while District Court Judge Garrett E. Brown, Jr. is presiding over those cases filed in the federal court.
